Water and Sewer Services Fee Ordinance #O-20-09-11

AN ORDINANCE OF THE CITY OF MATHIS, TEXAS, ESTABLISHING A FEE SCHEDULE FOR WATER AND SEWER SERVICES IN, PROVIDING FOR A SAVINGS AND SEPARABILITY CLAUSE, REPEAL OF CONFLICTING ORDINANCES AND PROVISIONS, AND ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, the costs assessed for Water and Sewer Services are increasing, and

WHEREAS the fees associated with providing Water and Sewer Services should cover the costs for providing those services, including all operating costs and be reasonable and fair, and 

WHEREAS, there is a need to update the fees associated with providing Water and Sewer Services within the City of Mathis, Texas; and 

WHEREAS, this Ordinances seeks to assess fees for providing Water and Sewer Services at a fair and reasonable rate within the City of Mathis, Texas

NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MATHIS, TEXAS THAT

Part 1. Fee schedule

           The City Council of the City of Mathis adopts the attached fees for providing Water and Sewer Services and hereby repeals all earlier ordinances which have adopted fee schedules for providing Water and Sewer Services.

Part 2. Fee changes

           The City Council may from time-to-time change the respective fees listed on the attached fee schedule as circumstances and conditions dictate.

 Part 3.  Invalidity

           It is the intent of the governing body that every word, phrase, sentence, clause and paragraph of this ordinance shall be considered separable and if any of which is judged to be invalid or unconstitutional by a court of competent jurisdiction, then all remaining words, sentences, phrases, clauses and paragraphs will remain valid and in full effect as if originally enacted without the inclusion of such invalid or unconstitutional provision.

  Part 4:  Conflicts

           Any provision of any previously enacted ordinance found to be in conflict herewith is expressly repealed to the extent that such conflict exists.

 Part 5:  Effective Date

          This ordinance shall take effect and shall be in full force and effect from and after its passage.

First reading was accomplished at a City Council meeting held on September 8, 2020, the second and final reading was held on _  September 14, 2020           _.
